Missione di un esperto ONU in Italia (30 novembre – 1 dicembre 2021)
Il Relatore Speciale ONU su sostanze tossiche e diritti umani, Marcos Orellana, è dal 30 novembre in Italia in una missione che si concluderà il 13 dicembre 2021 e che ha l’obiettivo di valutare il livello di tutela dei diritti umani da parte del Paese in rapporto alle sostanze e ai rifiuti tossici.
L’esperto ONU studierà gli effetti avversi di prodotti chimici, gestione dei rifiuti, pesticidi e contaminazione industriale sui diritti umani, con un’agenda di incontri con esponenti delle autorità governative centrali, regionali e locali oltre che con rappresentanti della società civile e delle comunità interessate.
“Sono rimasto molto colpito dai resoconti di importanti e persistenti problemi di contaminazione e gestione dei rifiuti, con il loro impatto su salute e qualità di vita degli italiani,” ha affermato Orellana.
“Come spesso accade, le conseguenze ambientali della gestione malsana di sostanze pericolose possono avere un impatto significativo sulla vita della popolazione, i cui segmenti più vulnerabili si trovano a pagare un prezzo sproporzionatamente alto.”
La missione prevede la visita di siti toccati da contaminazione industriale e l’incontro con le comunità interessate a Roma e nelle regioni Veneto, Campania and Puglia.
Per Orellana “è particolarmente importante ascoltare direttamente testimoni delle comunità locali per meglio comprendere in che modo sostanze tossiche e contaminazione abbiano un effetto sulle loro vite, sul loro accesso alle informazioni e a rimedi efficaci”. L’esperto ONU ha aggiunto di aspettarsi di “capire come il mio mandato possa assistere nella ricerca di soluzioni ai problemi esistenti e nel sostegno a qualunque pratica virtuosa attuata in Italia.”
In attesa della presentazione del rapporto dettagliato con le proprie conclusioni e raccomandazioni alla sessione di settembre 2022 del Consiglio dei Diritti Umani, Marcos Orellana condividerà le proprie osservazioni preliminari sull’esito della missione in un incontro con la stampa il 13 dicembre alle ore 14 all’Istituto Luigi Sturzo a Roma, Via delle Coppelle 35.
Marcos A. Orellana è il Relatore Speciale sulle implicazioni per i diritti umani della gestione e dello smaltimento ambientale corretti di sostanze e rifiuti nocivi.
The Special Rapporteurs are part of what are known as the Special Procedures of the Human Rights Council. The Special Procedures, the largest body of independent experts in the UN human rights system, is the general name for the Council’s independent investigative and monitoring mechanisms that deal with specific country situations or thematic issues in all parts of the world. Special Procedures experts work on a voluntary basis; they are not UN staff and do not receive a salary for their work. They are independent of any government or organisation and serve in their individual capacity.
BIOGRAPHY OF THE SPECIAL RAPPORTEUR
Dr. Marcos A. Orellana, Special Rapporteur on toxics and human rights
Dr. Marcos A. Orellana is an expert in international law and the law on human rights and the environment. His practice as legal advisor has included work with United Nations agencies, governments and non-governmental organizations, including on wastes and chemicals issues at the Basel and Minamata conventions, the UN Environment Assembly and the Human Rights Council. He has intervened in cases before the Inter-American Court of Human Rights, the International Tribunal for the Law of the Sea, the International Centre for Settlement of Investment Disputes and the World Trade Organization’s Appellate Body. His practice in the climate space includes representing the eight-nations Independent Association of Latin America and the Caribbean in the negotiations of the Paris Agreement on Climate Change. He has also served as senior legal advisor to the Presidency of the 25th Conference of the Parties of the UN Framework Convention on Climate Change.
Professor Orellana has extensive experience working with civil society around the world on issues concerning global environmental justice. He was the inaugural director of the Environment and Human Rights Division at Human Rights Watch. Previously he directed the trade and the human rights programs at the Center for International Environmental Law, and he co-chaired the UN Environment Program’s civil society forum.
Professor Orellana teaches International Environmental Law at the George Washington University School of Law and International Law at the American University Washington College of Law. He has also lectured in prominent universities around the world, including Melbourne, Pretoria, Geneva, and Guadalajara. He was a fellow at the University of Cambridge, visiting scholar with the Environmental Law Institute in Washington DC, and instructor professor of international law at the Universidad de Talca, Chile.
